Music Day in Canada is an initiative and product of The Lemmon Foundation (“the Foundation,” “we,” “us,” or “our”). The Lemmon Foundation was founded by Michael Scriven and Jessica Lemmon.

This Privacy Policy describes how we collect, use, disclose, retain, and protect personal information through musicdayincanada.com and related pages, forms, communications, and digital services collectively referred to as the “Website.”

We manage personal information in accordance with applicable Canadian privacy legislation, including British Columbia’s Personal Information Protection Act and, where applicable, the Personal Information Protection and Electronic Documents Act.

“Personal information” means information about an identifiable individual. It does not generally include business contact information used solely to communicate with someone in their professional capacity where applicable law excludes that information.

  • submit a Get Involved, partnership, volunteer, artist, venue, media, or general inquiry;

  • register your interest in Music Day in Canada;

  • contact us by email or through the Website;

  • participate in an event, program, survey, promotion, or other Foundation activity; or

  • otherwise communicate with us.

This information may include your name, email address, telephone number, city or region, organization, professional role, participation interests, communication preferences, and the contents of your message.

Please do not submit sensitive personal information unless it is specifically requested and reasonably necessary for the stated purpose.

Information collected automatically

When you use the Website, our systems and service providers may automatically collect limited technical information, including:

  • Internet Protocol address;

  • browser and device type;

  • operating system;

  • referring and requested pages;

  • access dates and times;

  • general geographic region derived from an IP address; and

  • diagnostic, security, and server-log information.

We may use cookies and similar technologies required for website functionality, security, form delivery, preference management, and performance measurement.

3. How We Use Personal Information

Unsubscribe requests will be processed within the period required by law. We may retain limited information on a suppression list so that we can respect your request.

Withdrawing consent does not affect uses or disclosures already lawfully made. In some circumstances, withdrawing consent may prevent us from providing a requested service or responding fully to an application.

The Website currently uses forms delivered through Vendasta-related services. When you interact with these forms, information may be transmitted directly to Vendasta or its infrastructure for processing on our behalf.

If advertising or additional non-essential analytics technologies are introduced, this Policy and the Website’s consent configuration should be updated before those technologies are activated.

We do not sell or rent personal information.

8. Retention

We retain personal information only for as long as reasonably necessary to fulfil the purposes for which it was collected and to satisfy applicable legal, accounting, reporting, insurance, and operational requirements.

Retention periods depend on the type of record and the purpose for which it is held. When information is no longer required, we securely delete, destroy, or anonymize it, subject to technical and legal limitations.

9. Safeguards

We use reasonable administrative, technical, and physical safeguards appropriate to the sensitivity of the information. These may include access controls, account security, staff and contractor confidentiality requirements, secure hosting, backups, and service-provider oversight.

No Internet transmission or storage system is completely secure. We cannot guarantee absolute security, but we will investigate and respond to suspected privacy or security incidents in accordance with applicable law.

10. Access, Correction, and Other Privacy Choices

Subject to applicable exceptions, you may request:

  • access to personal information we hold about you;

  • information about how it has been used or disclosed;

  • correction of inaccurate or incomplete information;

  • withdrawal of consent where consent is the basis for processing; or

  • deletion of information that we are no longer required to retain.

We may need to verify your identity before fulfilling a request. We will respond within the period required by applicable law or explain why additional time is needed.

11. Children and Young People

The Website is intended for a general audience. We do not knowingly collect personal information from children without appropriate consent where consent is required.

A parent, guardian, or young person who believes personal information was submitted inappropriately should contact us so that we can review and, where appropriate, delete it.

Event participation by minors may be subject to additional registration, consent, supervision, waiver, or media-release requirements communicated separately.

12. Third-Party Websites and Events

The Website may link to venues, ticketing services, artists, sponsors, social networks, event organizers, or other third parties. Those organizations operate under their own terms and privacy policies. We are not responsible for their privacy practices or content.

A linked event or registration process may also be administered by an independent local organizer. Review the organizer’s policies before submitting information or completing a transaction.

We may update this Privacy Policy as our practices, technologies, services, or legal obligations change. The revised version will be posted on the Website with an updated date.
